Privacy Policy

Introduction

This Privacy Statement applies to the BlueAnt Wireless websites, including blueant.com.au and blueantwireless.com, and to all business activities of BlueAnt Wireless Pty Ltd (ABN 34 107 793 546) and its subsidiary companies (“BlueAnt”), to the extent that they involve the collection, use, disclosure or handling of personal information.

BlueAnt understands the importance to its customers, business partners and clients of the discreet and confidential handling of personal information.

It is BlueAnt’s policy to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act in all activities involving the collection, use, disclosure and handling of personal information.

In this Privacy Statement, personal information has the meaning given in the Privacy Act 1988 (Cth), being information or an opinion (including information or an opinion forming part of a database), whether true or not and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable.

Collection of Personal Information

BlueAnt collects personal information only by lawful and fair means and not in an unreasonably intrusive way. Where practicable, BlueAnt will make known the purpose for which it is collecting personal information at or before the time of collection.

BlueAnt generally collects personal information directly from the individual concerned, including through its websites, customer service interactions, product registration, marketing subscriptions, order processing, and warranty or support enquiries.

The types of personal information BlueAnt may collect include name, email address, mobile phone number, billing and shipping address, order history, payment information (processed securely by third-party providers), website usage data, and communications history. Mobile phone numbers may be collected through opt-in forms (including website sign-up forms) for the purpose of sending marketing and transactional SMS messages.

BlueAnt may monitor, record, store, and review customer support interactions, including live chat, email, phone, and other support communications, for quality assurance, staff training, case management, fraud prevention, and service improvement purposes.

Use and Disclosure of Personal Information

BlueAnt uses personal information primarily for the purpose for which it was collected, including but not limited to:

• processing and fulfilling orders

• providing customer support and warranty services

• communicating order and shipping updates

• marketing and promotional communications (where permitted)

• improving products, services and customer experience

BlueAnt will not use or disclose personal information for a secondary purpose unless:

• the individual has consented; or

• the use or disclosure is permitted or required by law.

Direct Marketing

BlueAnt may use personal information for direct marketing purposes where permitted under the Australian Privacy Principles, including communications via email, SMS/text message, and post.

By providing your email address and/or mobile phone number, you consent to receive marketing communications from BlueAnt through those channels until you opt out. Marketing communications may include welcome offers, product updates, promotional offers, restock alerts, abandoned cart reminders, and similar messages.

Individuals may opt out of receiving direct marketing communications at any time by:

- Email: using the unsubscribe link included in every marketing email

- SMS/text: replying STOP to any marketing SMS received from BlueAnt 

- All channels: contacting BlueAnt directly at care@blueantwireless.com

BlueAnt will respect all opt-out requests promptly. Standard message and data rates may apply to SMS communications. SMS message frequency varies. Consent to receive marketing communications is not a condition of purchasing any product from BlueAnt.

Shipping & Logistics

For shipping and delivery purposes, BlueAnt may disclose relevant personal information to logistics and shipping providers. This may include providing tracking numbers to customer email addresses, or phone numbers solely for the purpose of communicating order and delivery status.

BlueAnt does not sell personal information and does not disclose personal information to unrelated third parties for their own marketing purposes.

Overseas Disclosure of Personal Information

Some personal information may be disclosed to overseas recipients for purposes such as data hosting, cloud storage, analytics, email and SMS marketing platforms, customer support systems, payment processing, or order fulfilment. These recipients may be located outside Australia.

BlueAnt takes reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with the Australian Privacy Principles, or as otherwise permitted under the Privacy Act 1988 (Cth).

Data Quality

BlueAnt takes reasonable steps to ensure that the personal information it holds is accurate, complete and up to date.

Data Security

BlueAnt takes reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. Security measures include administrative, technical and physical safeguards appropriate to the nature of the information held.

Access to personal information is restricted to authorised personnel and service providers who require access for legitimate business purposes. All BlueAnt staff are required to comply with confidentiality obligations.

Data Retention

BlueAnt retains personal information only for as long as is necessary for the purposes for which it was collected, including to fulfil legal, accounting, tax, warranty and reporting requirements. Marketing data is retained until you opt out, after which BlueAnt may retain limited information solely to ensure your opt-out preference is honoured. You may request deletion of your personal information by contacting care@blueantwireless.com, subject to any legal obligations BlueAnt has to retain certain records.

Openness

On request, BlueAnt will make available information about the types of personal information it holds, how that information is collected, the purposes for which it is used, and how it is managed in accordance with this Privacy Statement.

Access and Correction

Individuals may request access to the personal information held about them by BlueAnt, subject to the exceptions permitted under the Privacy Act 1988 (Cth). BlueAnt will also take reasonable steps to correct personal information where it is inaccurate, out of date, incomplete, irrelevant or misleading.

BlueAnt may charge a reasonable administrative fee for providing access, where permitted by law.

Identifiers

BlueAnt does not use government-issued identifiers (such as tax file numbers) to identify individuals, except where required or authorised by law. BlueAnt’s ABN is used for business identification purposes only.

Anonymity and Pseudonymity

Where practicable, individuals have the option of not identifying themselves or of using a pseudonym when dealing with BlueAnt, unless identification is required by law or is necessary for BlueAnt to provide a service.

Sensitive and Health Information

BlueAnt applies additional safeguards to the handling of sensitive information and health information, where such information is collected. Such information is collected, used and disclosed only in accordance with the Privacy Act 1988 (Cth) and with appropriate consent or legal authority.

BlueAnt's Clients & Service Providers

Where BlueAnt provides services to business clients that involve the handling of personal information, BlueAnt requires assurances that such information has been collected lawfully and in compliance with applicable privacy laws. Personal information handled for one client is not used for another client or for unrelated purposes.

Subcontractors & Service Providers

BlueAnt requires its subcontractors and service providers to comply with applicable privacy obligations and to handle personal information in accordance with this Privacy Statement and the Australian Privacy Principles.
